Insurance Claims/Dispute Resolution
Through
The
Appraisal Process
Using Binding Arbitration
If you are having trouble getting paid by your insurance company on a claim, or if you have a difference of opinion as to the "amount of loss" on a property insurance claim, Roofing Contractors Network can help you!
Anytime there is a difference of opinion as to the "amount" of loss, either party can request an appraisal. The other party has 20 days to appoint an appraiser. These two appraisers then have 15 days to agree on an umpire. If the two appraisers cannot agree on an umpire in 15 days, the District Judge, having jurisdiction, shall appoint one. The appraisers then state the amount of loss and if they cannot agree they must then submit the differences to the umpire. The umpire's decision is binding on the insurance company and the policy holder. Basically, any commercial or residential property claim can be settled using this procedure.
Laws have been on the books since 1888 in Texas which provide for relief where there is a difference of opinion between you and your insurance company as to the "amount of loss".

Success Stories
"In the Spring of 2009 I had filed a wind and hail claim against my commercial property insurance carrier. After several inspections by their adjuster we were told our building was old and the roof was worn out. Since there was no gaping hole in the roof we were told there would be no coverage for the damage on the inside of the building. I went to see the bank President at our local bank to borrow approx. $100,000.00 to pay for the new roof for my building since my tenant was paying $7,200.00 per month in rent, and since the hailstorm his inventory was getting damaged from rain getting in from the roof everytime it rained. My banker told me that I needed to call Jim Perry as MR. PERRY had won an arbitration in Waco, Texas and the result of that dispute was that the banker and his wife had been able to totally deck and reroof a large home there and he was very pleased with the result of MR. PERRY's work. I hired MR. PERRY and a short time later the Court Appointed Umpire awarded me $112,000.00. Due to the deductible and some depreciation we received $98,000.00 cash from the Insurance Company. From 0 to $98,000.00. All this was done for us by Jim Perry. I would recommend his services without hesitation.

"My name is John Miller. I live in Canada but I own a large shopping center in Sherman, Texas. In March of 2009 my building was hit by hail. I filed an insurance claim against my insurance company. My adjuster came out and wrote up $9.000.00 in damage, but since I had a $10,000.00 deductible they sent me no money. My roofer knew Jim Perry and said I should call him because "He's the only guy who can make them pay this claim". I called MR. PERRY and turned the entire claims process over to him. A short time later MR. PERRY had a settlement negotiated of $593,400.00 on this loss. The insurance company paid the claim based on MR. PERRY's work and I will be forever be indebted to him for his brilliant efforts".
- John Miller, Montreal, Canada
"My name is Barry Fountaine and we own a car lot in Sherman, Texas. The Insurance Company had paid $60,000.00 on a hail claim to 5 buildings we own. My roofer said Jim Perry could negotiate a better settlement through a process called Insurance Claims Appraisal. I called MR. PERRY and he took my case. MR. PERRY settled the case for $70,000.00 more in cash and $30,000.00 in depreciation which I will get when the work is complete. He increased my net claim by approx. $100,000.00.
